Your Email Signature May Get You Into Trouble
Of the dozens of emails that every person in your organization sends every day, many of them make a promise or ask someone else to do something.
Every such promise or request may create a legally binding obligation. You want to be very careful about who is on the hook for those legal obligations.
The email signature that you are currently using may make the situation very clear. That will be a good thing if the correct party has been identified, but otherwise it could be a bad thing. For example, if the wrong member of a corporate group is identified on the email signature, the liability might not be where it was intended to be.
The email signature may also make the situation very unclear if it does not identify the contracting party at all, or identifies the contracting party by a name which is not the full corporate name. In either case, the person on the hook might be the person who sent the email – not the company that he or she works for.
